Terms of Service

These Terms of Service ("Terms") form a binding agreement between you and WELFLUX ("WELFLUX", "we", "us") and govern your access to and use of the WELFLUX platform, including the AI Marketing Intelligence Engine, the Sales Kit Generator, and any related software, websites, APIs, dashboards, and content (together, the "Service").

By creating a WELFLUX account, accessing the Service, or generating a Sales Kit, you agree to these Terms. If you do not agree, do not use the Service.

You must be at least 18 years old and capable of entering into a binding contract to use WELFLUX. If you use the Service on behalf of a company, you confirm that you are authorized to bind that company to these Terms.

You are responsible for keeping your login credentials secure, for all activity that occurs under your account, and for notifying us at hello@welflux.com if you suspect unauthorized access.

WELFLUX is offered on a freemium model. The Free plan grants a limited number of Sales Kits and platform access. Paid plans (Starter, Pro, Business) and one-time credit packs (Starter Pack, Growth Pack) expand usage, workflow features, and platform access.

Subscription fees are billed in advance on a monthly basis and renew automatically until cancelled. You may cancel at any time from your Billing dashboard; cancellation takes effect at the end of the current billing period and credits already granted for that period remain available until expiry.

One credit is consumed per successful generation. If a generation fails or returns a partial result, no credit is deducted. Credits from pay-as-you-go packs expire after the period stated on the pack (3 months for the Starter Pack, 6 months for the Growth Pack).

All payments are processed by Stripe. Pricing is displayed in US Dollars and is subject to change with reasonable notice. We do not guarantee refunds for partially used billing periods.

You agree not to use the Service to:

• Generate content that is illegal, defamatory, fraudulent, or that infringes the intellectual property or privacy of others.
• Produce content that targets minors with marketing material or that promotes hateful, harassing, or violent behavior.
• Resell, sublicense, or systematically scrape outputs in ways that compete with WELFLUX.
• Interfere with the Service's operation, attempt to bypass rate limits, or probe for security vulnerabilities without our written permission.

We may suspend or terminate accounts that violate these rules, including immediate action where required to protect users or the Service.

The Sales Kits and other content produced by the Service are generated by AI models. Output can vary, may occasionally be inaccurate, and should be reviewed before publication. You are responsible for verifying claims, checking for trademark and brand guideline compliance, and ensuring that copy aligns with applicable advertising regulations on the destination platform.

Subject to your compliance with these Terms, WELFLUX assigns you all rights in the Sales Kit output that we are able to assign under applicable law, so that you can use it in your marketing. You retain ownership of any input you provide.

The Service itself — including the WELFLUX brand, logos, the AI Marketing Intelligence Engine, system prompts, orchestration framework, scoring system, UI, code, and supporting documentation — is owned by WELFLUX or licensed to us. We grant you a limited, non-exclusive, non-transferable license to access and use the Service in accordance with these Terms.

You may not reverse engineer the prompt engine, scrape model configurations, or attempt to extract proprietary system instructions from the platform.

Your use of WELFLUX is also governed by our Privacy Policy, which explains what we collect, how we use it, and how we keep it secure.

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that output will be error-free, that performance will be uninterrupted, or that any specific business result will be achieved.

To the maximum extent permitted by law, WELFLUX's aggregate liability arising out of or related to these Terms or the Service will not exceed the amount you paid to WELFLUX in the twelve months preceding the event giving rise to the claim. WELFLUX will not be liable for any indirect, incidental, special, consequential, or punitive damages.

You may terminate your account at any time by contacting hello@welflux.com or via the dashboard. We may suspend or terminate the Service to you immediately if we believe these Terms have been violated, if continued provision would create a risk to other users or to us, or if required by law. Sections of these Terms that by their nature should survive termination will do so.

We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated version on this page with a new "Last updated" date, and where appropriate by email. Continued use of the Service after the changes take effect constitutes acceptance of the revised Terms.
